Conflicts of Interest: Recent Ethics Opinions (1.5 NJ CLE Credit Hours in Ethics/Professionalism)

A review of many different jurisdictions' recent State Bar Ethic Committees' opinions in the area of conflicts of interest.

 

 

Criminal (& Civil) Copyright Infringement  (3.0 NJ CLE Credit Hours)

Civil law protects all of a copyright owner's exclusive rights while criminal law primarily focuses on the rights of distribution and reproduction. In as far as the criminal copyright infringement statutes mainly interpreted using civil case precedents, this lecture discusses both civil and criminal copyright, including the doctrines of Fair Use, First Sale, etc.

 

 

Criminal (& Civil) Trademark Infringement (2 NJ CLE Credit Hours)

This lecture covers the functions protected by trademarks, service marks and certification marks and then discusses the criminal counterfeiting statute and the elements of the crime, common defenses, penalties, etc.  As much of the law in this area is based on civil case precedent, civil copyright cases are discussed at length.

 

 

Debtor Strategies for the Housing Crisis (2.25 NJ CLE Credit Hours)

Discussion of various topics to assist your counseling of your debtor homeowner client including available options, alternatives to foreclosure, and foreclosure.

 

 

Disability and Gender Bias (1.5 NJ CLE Credit Hours in Ethics/Professionalism)

Discussion of the challenges and bias experienced by disabled lawyers and the laws protecting them including nondiscrimination and reasonable accommodation obligations in employment and courtroom. Discussion also includes current status of gender bias in the legal profession

 

 

Electronic Surveillance in Communications (2 NJ CLE Credit Hours)

Criminal investigations often involve real-time electronic surveillance. For instance, government agents may want to monitor a hacker as he breaks into a victim's computer system or set up a "cloned" email account to monitor a suspect sending or receiving child pornography. In cases involving cellular telephones, agents may wish to obtain "cell-site" location information for a suspect's cellular telephone to determine the suspect's approximate location at the time of a call. This course discusses the relevant statutes and case law which governs electronic surveillance in communications.

 

 

Ethics of Negotiation & Settlement (1.5 NJ CLE Credit Hours in Ethics/Professionalism)

Lecture covers a lawyer's ethical and professional obligations during negotiation and settlement.

 

 

Improving Client Relations & Selection (1 NJ CLE Credit Hour in Ethics/Professionalism)

This course offers tips on improving attorney/client relations and selection by becoming better client "choosers" and by applying some basic customer service principles. Topics include: recognizing potential problems in client selection; maintaining the client's comfort zone, and common conflict of interest scenarios to avoid.

 

 

Intellectual Property Licensing & Antitrust Issues (1.5 NJ CLE Credit Hours)

This course examines antitrust issues for the licensing of Intellectual Property. The lecture includes issues raised by exclusivity provisions in IP licensing and discussion of relevant cases that address licensing and other competitive issues.  

 

 

Racial Bias (Jury Selection/Legal Profession) (1.0 NJ CLE Credit)

Lecture concerning racial bias in the legal profession, workplace and courtroom. Discussion of racial bias in court, by attorneys, prosecutors, and in jury selection. Discussion of all seminal U.S. Supreme Court decisions in which racial bias was successfully raised as an issue on appeal.

 

 

Sarbanes-Oxley (1.5 NJ CLE Credit hours, .5 NJ CLE Hours in Ethics/Professionalism)

Discussion of the requirements and provisions of the corporate financial responsibility legislation including the Act's rules of professional responsibility for lawyers.

An overview of the detection and prevention of substance abuse with a focus on time management skills to aid in the reduction of some leading causes of substance abuse.

 

 

Trade Secret Theft & Misappropriation (2.25 NJ CLE Credit Hours)

Every year billions of dollars are lost to foreign and domestic competitors who deliberately target economic intelligence of technologies by exploiting trade secrets. This lecture covers laws protecting a business from espionage including cases detailing how businesses did or did not properly identify, value and safeguard trade secrets; securing physical and electronic versions of trade secrets, etc. in the context of the Economic Espionage Act. In depth discussion of the Act, related statutes and seminal cases.
